A female rapper pursuing her music career in Australia found herself facing a criminal charge of ‘Reckless Wounding’ after she had thrown a cup towards a female at a pub leaving the other woman with significant injury. The victim was required to undergo 16 stitches on her lip as a result.
She defended the charge in court with a different law firm, where she was found guilty and sentenced to jail for 18 months.
She felt confident in Ms Regan and retained her for a Severity Appeal in the District Court.
There was no stone left un-turned and Ms Regan produced a significant amount of new evidence for the severity appeal that was not provided to the court below. This included a detailed psychologist report, good character letters, affidavits, certificates of attendance at anger management courses and more.
Detailed submissions were made on behalf of our client to the presiding Judge of Sydney District Court.
Given the seriousness of the injuries sustained by the victim, the court had to conduct a balancing act when determining what penalty ought to be imposed.
Ultimately, the Judge allowed the appeal and overturned the jail sentence given my the local court magistrate.
Ms Regan’s client received an Intensive Corrections Order and was able to continue with her successful music career.
