Domestic violence offences withdrawn after complainant exposed as self serving and unreliable at Bankstown local court

A man was charged with a series of domestic violence offences against his sister, after he attended her home in an attempt to reconcile a family dispute.

His sister claimed that she was approached, assaulted, intimidated and followed to the police station by her brother. She described him as drug affected and aggressive at the time of the incident. Police interacted with our client within half an hour of the alleged incident, where to the contrary – he was calm, rationale and not under the influence. 

The matter proceeded to a defended hearing in Bankstown Local Court. 

During cross examination, Ms Regan’s clients sister became extremely argumentative and raising further alleged offending and detail that she had never raised to the police before.

When questioned about these inconsistencies, she appeared to give evidence that attempted to be self serving and she was unable to make appropriate concessions when pressed by Ms Regan.

It came out that she was an unreliable witness in court and the evidence she gave was self serving. 

As a result, the local court magistrate saw through the fabrications and did not accept her as a truthful witness. Our client was found Not Guilty of all domestic violence offences laid against him after a year of waiting for his opportunity to defend himself in court.
