A young 23 year old man from Broken Hill was charged with domestic violence offences against his now ex partner. These allegations occurred after he ended the relationship. He was granted bail by police at this point.
Only a few short days later, his ex partner attended the police station again and made further complaints against him now of a sexual nature. As a result of these allegations, he was bail refused by both the police and the court.
Ms Regan immediately applied to the Supreme Court for a bail application.
Numerous materials were obtained in support of the application, and Ms Regan wrote persuasive submissions to the Judge outlining why our client should be granted bail. We pointed out numerous deficiencies in the police case, particularly relating to the timing of the ex partner’s allegations, her motive and evidence showing her not taking the police process seriously.
Ms Regan made lengthy submissions in court to the Judge, and argued that not one single piece of evidence had been served in 13 weeks since he was charged and there was no reason for him to remain on remain in custody in circumstances where he is presumed innocent.
The Judge was persuaded by Ms Regan’s arguments and granted bail. He is now in a better position to defend the allegations brought against him.
