Background: Domestic Violence Charges Before the Local Court

Our client, a middle-aged man with an otherwise clean criminal record, was charged with two domestic violence offences following an incident involving his wife:

At sentencing before Goulburn Local Court, we submitted that:

  • In 17 years of marriage, there had been no prior incidents of domestic violence

  • The client had never previously appeared before a court

  • He was a person of good character

  • He had strong prospects of rehabilitation

  • He accepted responsibility at the earliest possible opportunity

We argued that recording a conviction would be disproportionate, particularly where the offending was isolated, out of character, and unlikely to be repeated.

The Court was urged to impose a Conditional Release Order Without Conviction, allowing accountability while protecting the client’s future.

 

Outcome: Conditional Release Order Without Conviction

The Magistrate accepted the defence submissions.

✅ The order was imposed for a period of 2 years
No criminal record was recorded for either offence
