No criminal record imposed by the ACT Magistrates Court for woman CHARGED WITH DOMESTIC VIOLENCE assault AGAINST her mother

Ms Regan appeared in the ACT Magistrates court for a 33 year old woman who lived in Canberra, ACT.

On the incident date, Ms Regan’s clients mother took her daughter to hospital due to concerns about her mental health. Ms Regan’s client had no knowledge of this until she arrived. 

In the wake of feeling betrayed, not believed and fearful at the thought of being kept in hospital, our client struck her mother in the face. She was then charged with Common Assault pursuant to Section 26 of the Crimes Act 1900 (ACT).

Our client recognised that she did need to seek help to address her mental health given the outburst towards her mother. She instructed Ms Regan to plead guilty to the offence.

We guided and advised her on the materials to prepare and Ms Regan made lengthy submissions to the court outlining her mental health, remorse and otherwise good character. 

The court decided not to impose a criminal record in the circumstances.
