Ms Regan’s 24 year old client was charged by Windsor Police with charged of hinder and resist police.
The charges came as a result of an interaction with his friend who had been arrested outside the Richmond Inn by police. He approached his friend and asked if he wanted him to contact anyone to let them know of his arrest.
Police officers at the scene were rude and abrupt towards him and subsequently gave him a move on direction from the area. Feeling like the police conduct was unreasonable, Ms Regan’s client took out his phone to record police interactions. He continuously requested the police officers names, which was refused and he was subsequently tackled to the ground and arrested by police.
The interaction was recorded on camera, including the rough arrest. After looking at the footage, Ms Regan identified that the actions of police against our client were completely illegal.
Ms Regan wrote detailed ‘legal representations’ (also known as negotiations with the police area command) to police, outlining why the charges should be withdrawn. The footage taken by Ms Regan’s client was exposed to the prosecution.
After considering what was outlined by Ms Regan, Windsor Police and prosecutors agreed to withdraw all charges.
It is important to speak to a criminal lawyer at an early stage, as if issues are identified quickly – this could lead to charges being withdrawn at an early stage and a defended hearing avoided.
